Last April, Governor Cuomo signed a new anti-harassment law containing provisions for private and public employers related to sexual harassment in the workplace. These provisions provided for protection from not only other employees, but also vendors, consultants, contractors and others providing services. Most importantly to employers, the new law requires all employers with 1 or more employees to comply with very defined sexual harassment policy and training requirements. Specific requirements include:
- Implementing a sexual harassment policy that includes defined minimum standards by October 9, 2018;
- Establishing a sexual harassment prevention training plan by the October 9, 2018 deadline; and
- Developing a training program or using the New York State model training program. This training is required to be provided to all employees, be interactive, comprehensive, and completed by October 9, 2019.
